§ 21-20. Premises frequented by persons under influence of illegally obtained controlled substances or used for illegal possession, distribution, etc., of such substances.
Any office, store, shop, restaurant, dance hall, theater, poolroom, clubhouse, storehouse, warehouse, dwelling house, apartment, building of any kind, vehicle, vessel, boat or aircraft which, with the knowledge of the owner, lessor, agent of any such lessor, manager, chief executive officer or operator thereof, is frequented by persons under the influence of illegally obtained controlled substances, as defined in section 54-524.2 of the Code of Virginia, or for the purpose of illegally obtaining possession of, manufacturing or distributing such controlled substances, or which is used for the illegal possession, manufacture or distribution of such controlled substances, shall be deemed a common nuisance. It shall be unlawful and a Class 1 misdemeanor for such owner, lessor, agent of any such lessor, manager, chief executive officer or operator to knowingly permit, establish, keep or maintain such a common nuisance.
