§ 21-223. Appeal of decisions of the police chief.

  • Any applicant or holder of a permit issued pursuant to this article may appeal denial of their application; any suspension or revocation of their public dance hall permit; or surrender of their restaurant license as allowed under section 13-15 of the Code of the City of Roanoke to the city manager under the following procedures:

    (1)

    An applicant or holder of a permit must file their appeal with the police chief within thirty (30) days of the denial, suspension or revocation of a public dance hall permit.

    (2)

    The city manager will conduct a hearing of the appeal within thirty (30) days of the applicant or holder's filing of an appeal.

    (3)

    The city manager shall render a written decision on the appeal within ten (10) business days following the hearing after consulting with the city attorney. The public dance hall permit or restaurant license may be:

    a.

    Reinstated without conditions.

    b.

    Reinstated with conditions and/or restrictions.

    c.

    Temporarily suspended for a period to be set by the city manager.

    d.

    Permanently revoked.

    (4)

    The decision of the city manager and/or his/her designee shall be the final decision regarding the denial, suspension or revocation of a public dance hall permit or restaurant license.
